1. Acceptance of Terms

By accessing or using MarketPing (marketping.finance), you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms constitute a legally binding agreement between you and the operator of MarketPing.

2. No Financial Advice (The Golden Rule)

MarketPing is a technical notification tool. We are not financial advisors, brokers, or tax professionals. All alerts are data-driven notifications based on third-party feeds. You alone are responsible for your trades and investment decisions. MarketPing does not provide financial, investment, or legal advice of any kind.

3. Limitation of Liability (Absolute)

To the maximum extent permitted by law, MarketPing and its New Mexico LLC shall not be liable for any financial losses, lost profits, or indirect damages resulting from:

  • Latency: Delays in market data or alert delivery.
  • System Failure: Interruptions in third-party APIs (Telegram, AWS, Resend).
  • Inaccuracy: Errors or omissions in the data provided.

Our total liability for any claim is strictly limited to the amount paid by you to the service in the twelve (12) months preceding the claim.

4. Account Responsibilities

You are responsible for maintaining the security of your account and your Telegram integration. You agree not to use the service for any unlawful activities or to attempt to scrape, reverse-engineer, or bypass the intended alert logic of the MarketPing platform.

5. Subscriptions and Payments

Payments are processed via secure third-party providers. By subscribing to a paid tier, you authorize the recurring charge of the applicable fees. You may cancel at any time via your dashboard; however, unless required by law, payments are non-refundable.

6. Binding Arbitration & Class Action Waiver

All disputes arising from these terms shall be resolved through binding arbitration in the State of New Mexico, USA. You explicitly waive your right to participate in a class-action lawsuit or class-wide arbitration.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
